RiverPlex Liability Waiver

Peoria Park District and YMCA RiverPlex Recreation and Wellness Center Fitness Center Operations Waiver
The Peoria Park District and Greater Peoria Family YMCA are committed to conducting fitness programs and activities in a safe manner and hold the safety of participants in high regard. Participants and parents or guardians of minors must recognize that there is an inherent risk of injury when choosing to participate in these fitness programs and activities. By signing this waiver, you acknowledge that you have reviewed the District rules and policies and agree that the District and YMCA equipment, staffing, supervision levels, rules, and policies demonstrate a conscious regard for safety. You further agree that you will immediately cease and or report any activity that you believe is unsafe for any reason.
You are solely responsible for determining if you or your minor child or ward are physically fit and or adequately skilled for the activities contemplated by this agreement. It is always advisable, especially if the participant is pregnant, suffers from an underlying medical condition, takes medication, smokes, has a family history of coronary disease, or has recently suffered an illness, injury, or impairment, to consult a physician before undertaking any physical activity.
Warning of Risk
Aerobic and other fitness exercises, including passive or resistive weight training, use of stair machines, jogging, free weights, and other training devices, pose a substantial risk of serious injury, including death, even with careful preparation, instruction, medical advice, conditioning, and equipment. Risks may include acts of God, slipping, falling, equipment failure, supervision or instruction failure, premises defects, and all other circumstances inherent to fitness activities and programs.
- Heart attack, stroke, and circulatory problems
- Bone and joint injuries
- Back and neck injuries
- Shin splints
- Muscle strain and other muscle injuries
- Foot problems
Climbing walls are intended to challenge and engage the physical, mental, and emotional resources of each participant. However, despite careful preparation, instruction, medical advice, conditioning, and equipment, there is still a risk of serious injury. Hazards include overexertion, slips and falls, loose or damaged artificial holds, being fallen on by other users, belay or belayer failure, lack of good physical conditioning, inadequate or defective equipment, inadequate instruction or supervision, poor technique, carelessness, horseplay, premises defects, and all other risks inherent to climbing wall use.
Waiver and Release of All Claims and Assumption of Risk
By signing up and participating in this program or activity, you expressly assume the risk and legal liability and waive and release the District, RiverPlex, and YMCA from all claims for injuries, damages, or losses that you or your minor child or ward might sustain as a result of participating in any and all activities connected with and associated with this program or activity.
You recognize and acknowledge that there are certain risks of physical injury associated with participating in this program or activity, and you voluntarily agree to assume the full risk of any injuries, damages, or loss, regardless of severity, that you or your minor child or ward may sustain as a result of such participation. You further agree to waive and relinquish all claims that may accrue as a result of participation in this program or activity and fully release and forever discharge the District, RiverPlex, and YMCA from any and all such claims.
